1. GENERAL:

• This Contest shall be conducted by The Brick Warehouse LP (“The Brick”) for customers to enter. A customer is referred to as “You and “Your”.
• The contest runs from December 10, 2021 at midnight to January 3, 2022 at midnight.

Ways to enter:

• If You finalize a purchase of any product at any Brick store located in Calgary, Alberta using any payment method, You will be automatically entered to win a prize on the Draw Date.

No purchase necessary method of entry:

• To enter, You must attend the new Brick Calgary Shawnessy store at 315 Shawville Blvd SE (“Store”) to scan the exclusive contest QR code. A sales associate will provide You with a QR code that will take You to the online entry ballots. You must complete and submit the online entry (both the automatic entries and on-line entries will collectively be referred to as “Entry/Entries”)
• It is a requirement of winning that you MUST be available to attend in person at the Shawnessy Calgary Brick on January 15, 2022. No exceptions.
• Limit of one no purchase necessary Entry per person during the Contest Period. Any attempt to manipulate the Contest will result in You being disqualified.
• Odds of winning decrease as the number of Entries increase during the Contest Period.
• Draw Date: January 5, 2022 at 11:00 a.m. MST

2. ELIGIBILITY:

• The contest is open to all residents of Alberta who have reached the age of majority on or before the Draw Date except employees, representatives and agents of The Brick, and all people employed as contractors or sub-contractors by The Brick, and their immediate family members living in the same household.
• You agree to abide by the Rules as set out herein, subject to all federal, provincial and municipal laws. It is a condition of eligibility that the winner authorizes The Brick to announce and publish his/her name, address and photograph, without remuneration or consideration, in any forthcoming publicity.
• You must be able and available to attend the Store IN PERSON on January 15, 2022.

3. PRIZE:

There are 10 (ten) prizes to be won. The allocation of prizes will be revealed on January 15, 2022, by participation in a game at the Store, as set out in #6 below.

• 1 $10,000 Trip Voucher for Airline or Travel Company of choice
• 1 of 9 $500 Brick Gift Cards

• The Brick’s liability for defective merchandise shall be limited to repairing defective or, where appropriate, to exchanging such defective goods within the manufacturer’s warranty period and in accordance with such warranties. In no case shall The Brick refund or otherwise compensate the winner beyond repairing or exchanging defective goods.
• Gift Card prizes must be accepted as awarded, may not be sold or transferred, and are not convertible to cash. Prizes are non-transferable, non-exchangeable, and non-refundable. However, the $10,000 grand prize may be exchanged for a cash equivalent, if preferred.

4. DRAW PROCEDURES:

On the Draw Date a representative from The Brick’s corporate office in Edmonton, Alberta will:

• compile a list of all purchases made and on-line ballots received during the Contest Period. A representative from corporate office will make fifteen (15) random draws from all Entries to obtain ten (10) winners (“Eligible Winner”). The additional Entries drawn are back up Entries in the event any initial Eligible Winner is non-responsive after contact, fails to comply with the Contest Rules, or is unable to complete the skill testing question, and those names will be recorded in the order they were drawn (“Alternate Winner(s)”).
• A representative from corporate office will use his/her reasonable efforts to contact each Eligible Winner first by phone then by email, on or after the Draw Date. If any Eligible Winner cannot be reached by one of the methods above or has not contacted The Brick within three (3) days of The Brick leaving messages to do so (“Contact Date”), then that person will be disqualified, and The Brick shall proceed to contact the next Alternate Winner.

5. DECLARING THE PRIZE WINNERS:

Each monthly Eligible Winner whose name has been selected on the Draw Date must:

1. Be over the age of majority in the province in which they reside;
2. Within three (3) business days following the Contact Date, correctly answer a time-limited, arithmetical skill-testing question without the assistance of any person or mechanical/recording device(s). The skill-testing process shall be administered at a pre-arranged time and place;
3. Execute a declaration and release form confirming compliance with the Official Contest Rules and acceptance of the Prize; and
4. Should the Eligible Winner fail to answer the skill-testing question correctly or is unable to attend at the time and place designated by The Brick for the administration of same, that Eligible Winner shall be disqualified, and the skill-testing question shall be administered to the next Alternate Winner.

6. LUGGAGE GAME:

Each Confirmed Winner must attend the Brick Calgary Shawnessy location on Saturday, January 15, 2022 at 1pm MST, to play the Luggage Game.

Luggage Game: Confirmed Winners will each select one of ten suitcases that are set up in the store for the purpose of the game (the luggage is not part of the prize). Nine suitcases will contain a $500 Brick Gift Card. One suitcase will contain the $10,000 Grand Prize. Once all players have picked their luggage*, they will open the suitcases at the same time to reveal which prize they have won. All prizes will be accepted as awarded.

*The playing order of the luggage game will be determined by random draw on January 15, 2022 by a Brick Store employee.

If a Confirmed Winner fails to arrive on the designated day or is unable to attend the Store on the designated day, they will not be eligible to win a prize. Should any “Confirmed Winner” fail to attend the Store to play the luggage game on January 15, 2022, The Brick will ensure that the $10,000 prize is in play for the remaining Confirmed Winners.

7. Additional Terms:

By participating, You agree that: a) these Official Contest Rules and The Brick’s records of the draw or any other aspect of this contest shall be final and conclusive in all respects; and b) release, discharge, indemnify and hold harmless The Brick and its trustees, directors, officers, and employees from any liability, claims, damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize.

8. LIMITATION OF LIABILITY:

The Brick shall not be responsible for print or typographical errors in any Contest-related materials; for transactions that are posted late or incorrectly or are lost due to computer or electronic malfunction, or mail that is not delivered due to any reason whatsoever. The Brick reserves the right to amend or vary the Official Contest Rules, including the imposition or addition of new rules which are deemed by The Brick in its sole discretion necessary for business efficacy.

9. PRIVACY POLICY:

The Brick will use the contact information provided in contest entries for administration of this Contest and/or to ascertain Your needs and market to You. We may communicate with You for any of these purposes by telephone, fax, text messaging, or other electronic means, and automatic dialing-announcing device, at the numbers You have provided us, or by internet, mail, email and other methods. By entering this Contest, You acknowledge and agree to give permission to The Brick to collect, use and disclose Your personal information in accordance with The Brick’s privacy policy (“Privacy Policy”). Once the Winners have been confirmed, The Brick will arrange for delivery of the Prize to the Winner living within 50 km of a Brick store. Should the Prize Winner live outside of the specified delivery area, The Brick will ship the Prize to the Distribution Centre/Store closest to them. The Brick’s Satisfaction Guarantee, Price Guarantee and Price Protection policies as published from time to time shall not be applicable to any merchandise obtained as a result of redeeming the Brick Gift Card or any portion thereof.
